Justice Alito‘s book purports to answer the Court’s critics—by rebutting a caricature and ignoring the ways in which his own behavior contradicts his claims.
Alito's insistence that the Court is apolitical and not doing anything untoward reminds me of Senator Larry Craig's insistence that he wasn't soliciting sex from men in bathrooms.
Both men are just too upstanding for such accusations.
The skewed treatment of balance-of-equities in favor of the government is the most consistent problem these days in shadow docket rulings. Hand in hand with that is the unwarranted deprecation of irremediable harm to the opposing litigants.
—Is Donald Trump in mental decline, do you think? Has he lost his fastball?
The poster child for the Court’s disregard for the balance of equities is its order in DVD vs DHS. Sending people to Equitorial Guinea where the NYT has documented hooding and torture of deportees should be a clear and easy show of risk of irreparable harm vs the DHS claim that denial of its requested relief will impact “logistics” of deportation flights.
sounds about right for his level of “scholarship.”
Highly recommend following the link to the Youtube video for an explanation of the way the Shadow Docket is now being used/abused. Thank you.
